Please read these Terms of Service ("Terms") carefully before using the AcroBabyKids platform (acrobabykids.com, mobile applications, and related services). By creating an account or using our services, you agree to be bound by these Terms in their entirety.
IMPORTANT: AcroBabyKids provides video content featuring physical and acrobatic exercises for parents to perform with their children. These activities carry inherent risks of physical injury. By using our service, you acknowledge and accept these risks. Please read Sections 1-5 carefully.
1. Assumption of Risk
You acknowledge and agree that physical activities, including but not limited to acrobatic exercises, gymnastics, stretching, yoga, and other movements demonstrated in AcroBabyKids videos, carry inherent risks of physical injury, including but not limited to bruises, strains, sprains, fractures, concussions, and other injuries to both adults and children.
By using our service, you voluntarily assume all risks associated with performing any exercises or activities shown in our content, whether performed exactly as demonstrated or with any modifications. You understand that results may vary and that not all exercises are suitable for all individuals or age groups.
2. Parental Supervision Required
ALL exercises and activities shown in AcroBabyKids videos MUST be performed under the direct, active supervision of a parent or legal guardian at ALL times. A child must NEVER be left unattended during or after any exercise activity.
As the parent or legal guardian, you are fully and solely responsible for:
- Assessing whether any exercise is appropriate for your child's age, developmental stage, and physical condition
- Providing direct, hands-on supervision throughout all activities
- Ensuring a safe exercise environment (appropriate surface, adequate space, removal of hazards)
- Stopping any activity immediately if your child shows signs of discomfort, pain, distress, or fatigue
- The safety and well-being of your child at all times
3. Medical Disclaimer
The content provided by AcroBabyKids is for informational and entertainment purposes only and does NOT constitute medical advice, physiotherapy, or professional health guidance of any kind.
You should:
- Consult your pediatrician or qualified healthcare provider before starting any exercise program with your child
- Seek medical advice if your child has any pre-existing health conditions, developmental concerns, or physical limitations
- Not use our content as a substitute for professional medical care or physical therapy
- Seek immediate medical attention if any injury occurs during exercise activities
4. Physical Activity Warning
WARNING: Acrobatic and physical exercises involve movements that can result in serious injury if performed incorrectly, without proper supervision, or in an unsafe environment. This includes but is not limited to lifts, inversions, balancing, and dynamic movements with children.
Before performing any exercise, you must:
- Ensure you have a safe, padded, or soft surface beneath you (exercise mat, carpet, grass)
- Clear the area of any hard objects, furniture edges, or other hazards
- Ensure adequate space for the movements being performed
- Stop immediately if you or your child experience any pain, dizziness, or discomfort
- Never force any movement or position on a child
- Warm up properly before performing exercises
5. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ACROBABYKIDS, ITS OWNERS, DIRECTORS, EMPLOYEES, INSTRUCTORS, CONTENT CREATORS, PARTNERS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY:
- Physical injuries, bodily harm, or death arising from performing exercises or activities shown in our content
- Direct, indirect, incidental, special, consequential, or punitive damages of any kind
- Loss of profits, data, use, goodwill, or other intangible losses
- Damages resulting from improper execution of exercises
- Damages resulting from performing exercises without proper supervision
- Damages resulting from performing exercises in an unsafe environment
- Any injury to a child resulting from activities inspired by or related to our content
This limitation applies regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise), even if AcroBabyKids has been advised of the possibility of such damages.
6. Indemnification
You agree to indemnify, defend, and hold harmless AcroBabyKids, its owners, directors, employees, instructors, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including attorney's fees) arising from:
- Your use of the service
- Any injury occurring during or as a result of activities performed while using our content
- Your violation of these Terms
- Any third-party claims arising from your use of the service
7. Age Requirements
You must be at least 18 years of age to create an account and use our services. By creating an account, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.
Children may only participate in activities shown on AcroBabyKids under the direct supervision of their parent or legal guardian. Children are not permitted to use the platform independently or to create their own accounts.
8. No Warranties
THE SERVICE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR SUITABILITY FOR ANY SPECIFIC CHILD OR INDIVIDUAL.
AcroBabyKids does not warrant or guarantee:
- The safety or suitability of any exercise for any specific individual or child
- That any specific health or developmental outcomes will result from using our service
- That the service will be uninterrupted, error-free, or free of harmful components
- The accuracy, reliability, or completeness of any content
9. Subscription & Payment Terms
AcroBabyKids offers free and premium subscription plans:
- Free Plan: Access to selected free videos.
- Premium Plan: Full access to all videos and content for a recurring subscription fee.
Premium subscriptions auto-renew at the end of each billing period unless cancelled before the renewal date. You may cancel your subscription at any time through your account settings or by contacting us. Refunds are handled on a case-by-case basis and are at the sole discretion of AcroBabyKids.
Payments are processed through Stripe, PayPal, or Apple In-App Purchase (on iOS devices). Your payment details are handled entirely by these third-party providers. For iOS subscriptions purchased through Apple, Apple's terms of service and refund policies apply.
10. User Account
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized use of your account
You may delete your account at any time through the Settings section in the mobile application or by contacting us at [email protected]. Account deletion is permanent and will result in the removal of all associated data, cancellation of active subscriptions, and loss of access to premium content.
We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to violation of these Terms.
11. Intellectual Property
All content on AcroBabyKids, including but not limited to videos, images, text, graphics, logos, and audio, is the exclusive property of AcroBabyKids or its licensors and is protected by copyright and other intellectual property laws.
You may NOT:
- Copy, reproduce, distribute, or publicly display any content
- Record, screen-capture, or download videos (except where explicitly allowed)
- Modify, create derivative works from, or reverse-engineer any content
- Use any content for commercial purposes without prior written consent
- Share your account or access credentials with others
12. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the Republic of Estonia and applicable European Union regulations. Any disputes arising from or relating to these Terms or your use of the service shall be subject to the exclusive jurisdiction of the courts of the Republic of Estonia.
13. Changes to These Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated by posting updated Terms on our website with a new effective date. Your continued use of the service after changes are posted constitutes acceptance of the modified Terms.
14. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
